An employee of a nonprofit continuing care community has been allowed to proceed with claims for retaliation for seeking family medical leave and disability discrimination. A federal District Court in Pennsylvania has denied the employer’s motion to dismiss. Michele Sine, a floor technician at the Rockhill Mennonite Home, claimed she advised her employer in January, 2015, that she would require several weeks leave for hysterectomy surgery, but said she was told she did not qualify for FMLA leave because she had not worked there for a full year.
