Mention of Official’s Admiration in Fundraising Letter
Does Not Misuse Person’s Name or Invade Privacy
Union president has no claim against educational “think
tank” for accurate quotation of his public statement at press
conference
Excerpt
When an educational research and advocacy center quoted the
President of a teachers’ union as admiring its work in an
educational fundraising mailing, the President, whose union is generally
at odds with the group, sued for invasion of privacy and misappropriation
of his name for commercial benefit.
A trial court denied the center’s motion for summary judgment, but the Court of Appeals of Michigan has reversed. The Court has held that none of the President’s claims is meritorious. (Battaglieri v. Mackinac Center for Public Policy, No. 245862, 3/18/04.)
