Two state laws imposing restrictions on telephone solicitors soliciting
for charity have been found valid by the courts.
The Supreme Court of Utah has reversed a state trial court and held that the federal Telephone Consumer Protection Act did not preempt the field and a state law with more restrictive limitations could be applied to calls within the state. The Eight Circuit Court of Appeals has reversed a District Court and held that a North Dakota statute applying restrictions to professional solicitors which are not applicable to charity employees or volunteers is constitutional.
