The Seventh Circuit Court of Appeals has affirmed a District Court
decision that the State of Illinois cannot Constitutionally demand
that the Illinois Clean Energy Foundation contribute $125 million
to the state for bond payments and state environmental agencies.
Such confiscation would be a taking without just compensation, the
Court has held.
