The First Circuit Court of Appeals has held that a court has authority
to look into the actual conduct of a nonprofit credit counseling
agency and its recognition as a 501(c)(3) charity by the Internal
Revenue Service does not necessarily bring the agency within the
charity exemption from suit under the Credit Repair Organizations
Act.
