A nonprofit referral service that helps parents find childcare resources has been found to be not liable for injuries suffered by a child taken to a provider on the agency’s referral list. A Court of Appeals in Ohio has affirmed summary judgment that the referral agency had no duty to protect the child. (Fishpaw v. Francisco, Ct. of App., 10th App. Dist., No. 05AP-861, 6/30/06.)
Action for Children provides families with information on home care providers, child-care centers, preschools and school-age programs. It does not provide direct services or recommend providers, but merely acts as a referral service.
