Assets of Nonprofit Not Subject
To Forfeiture for Crimes of Board Chair

Government claimed Chair gained control over corporation
by false proxies to eliminate members’ rights

The assets of a nonprofit corporation would not be subject to criminal forfeiture if the Chair of the Board were to be convicted of mail fraud, the Ninth Circuit Court of Appeals has ruled. It has vacated an injunction that a trial court had imposed, freezing the assets and imposing a receivership on a nonprofit that the defendant allegedly controlled.
