Court Grants Cy Pres for Trust
To Fund Relocated Public Garden
City destroyed garden for revitalization project,
but will get benefit of funds for another site

In its first review of a 1999 state enactment of the cy pres doctrine, the Supreme Court of Iowa has decided that the a charitable trust created to support a memorial garden in the City of Storm Lake can be used to fund a garden at a different location when the original garden has been destroyed to make way for a city revitalization project.  It has reversed a trial court decision holding that the trust should terminate and benefit the donor’s successors.
