Court rules that Administration may not
limit eligibility to public charities
A federal District Court in the District of Columbia has ruled that a private operating foundation may participate in the Combined Federal Campaign of charitable solicitation and that the Office of Personnel Management may not enforce a new regulation limiting participation to “public charities.” The Court has held that a 1988 statute passed by Congress requires the eligibility requirements to be the same as they were in 1984 when private foundations were permitted to participate.
