Court says EEOC complaint constitutes
a formal administrative proceeding
The failure of a nonprofit organization to notify its insurance carrier of an employment discrimination claim with the Equal Employment Opportunity Commission justifies the carrier in denying coverage to defend a lawsuit when the employee subsequently filed the charge in court.
The federal District Court in the District of Columbia has ruled that the EEOC claim is “a formal administrative or regulatory proceeding” as set forth in the policy which required notice from the insured to the carrier.
