Use of fictitious names for unincorporated “charities”
makes individuals personally liable for misrepresentations
Three individuals who registered fictitious names used for soliciting charitable funds in Missouri have been enjoined and fined personally because they could not claim that they were protected from personal liability common to corporations. The Court of Appeals of Missouri has affirmed a trial court judgment of a permanent injunction, $8344 in restitution, and $5000 in penalties for violation of the state’s Merchandising Practices Act, which covers improper charitable solicitation.
