A boss’s “frequent” comments about age are sufficient to make out a prima facie case of age discrimination, an appellate court in New York has held. It has affirmed a trial court decision refusing to grant summary judgment to the employer. Lyn Rollins was hired at age 58 to be the executive director of the nonprofit Fencers Club and was demoted and then fired at age 59.
