A release and waiver of claims for injury signed by student athletes has been held ineffective against claims by two student athletes hurt during football practice at a nonprofit junior college in Pennsylvania. An appellate court has reversed a trial court decision dismissing the claims on the basis of their waiver. The students signed a Waiver of Liability and Hold Harmless Agreement that said they “release, waive, discharge, and covenant not to sue Lackawanna College” from any and all liability “arising out of or related to any loss, damage or injury, including death, that may be sustained by me, or to any property belonging to me, while participating in such athletic activity.” While...
