No time limit on AG’s breach of fiduciary duty action

A federal District Court in Rhode Island has reconsidered a previous opinion and agreed with the Attorney General of Massachusetts that there is no statute of limitations in Massachusetts that limits the time within which the Attorney General may bring a breach of fiduciary duty action against the directors of a public charity. The new decision comes following one attempting to separate issues in the controversy over the withdrawal of the New England Medical Center from the Lifespan health system centered in Rhode Island.
