May Deli give employees’ tips to charity?

Employees of New Orleans Deli and Dining charged their employer with improperly depriving them of portions of the cash left in a “tip jar” next to the cash register and tips added to patrons’ credit card charges. The employees said the employer was using some of the money to make gifts to charity and keeping some for the company. The employees charged that the funds were improperly converted from the employees and that the Deli had been unjustly enriched. A federal District Court in Louisiana has refused to grant a summary judgment in favor of the company to dismiss the case.
