Your Legal Questions Answered

If we solicit for small gifts, do we need to register?

If we secure contributions from other states for our nonprofit organization, do we need to register or do anything? Our contributions are targeted to individuals seeking $200 or less per individual.

If you are soliciting charitable contributions anywhere, you should check for the law of that state to see whether you have to register to solicit. There are 39 states, the District of Columbia, and even some municipalities that have registration requirements. If you solicit contributions, no matter what the size, where you are supposed to be registered and you are not registered, you can be enjoined from continuing and fined.
