The Roman Catholic Bishop of Springfield MA lacks standing to challenge a modification in the use of scholarship money left for the benefit of students of two parishes within the Diocese, the Appeals Court of Massachusetts has ruled. Stanley Jez had left a testamentary trust to provide scholarships to boys of two particular parishes to study forestry at Paul Smith’s College or the University of Massachusetts at Amherst. The trustee brought an action to apply the cy pres doctrine to expand utilization of the trust. The state Attorney General consented.
