A prospective juror who is a member of a Roman Catholic diocese being sued in a sexual abuse case should be excluded for cause, the Supreme Court of Vermont has ruled. She was very likely to be aware of the bishop’s assessment of the financial risk of the litigation, raising concern that churches, including hers, could be lost, the Court said. The question arose in a complicated appeal from a suit begun in 2004 by a man who claimed he had been abused by a priest in 1977. The case first went to trial in 2007, but ended in a mistrial. In a second trial, the jury awarded damages of $15,000 to the plaintiff, but ruled that he sued more than six years after he knew of the molestation. Ordinarily...
