Directors of a California nonprofit aquatic center who sued other directors for breach of fiduciary duty have been awarded approximately $83,000 in attorneys’ fees when two courts have determined that defendants’ motion to dismiss the claim under the state’s anti-SLAPP statute was frivolous. Bruce Ibbetson and Donna Warwick, both directors of the Newport Aquatic center, a public benefit corporation, brought suit against three other directors and the executive director in 2017, asserting 10 causes of action based on alleged financial misconduct and misappropriation of funds.
