An appellate court in Kentucky has affirmed a trial court decision dismissing age discrimination claims brought by 18 employees who were dismissed in a reorganization and restructuring. The Park DuValle Community Health Center in Louisville and its CEO were sued after a 2012 cutback terminated 41 employees, 19 over the age of 40. The organization had been losing money and failing to comply with federal standards for its funding. Some of the duties had been assigned to existing employees or combined with other positions.
