The Tenth Circuit Court of Appeals has affirmed a decision granting summary judgment against a donor who claimed he was defrauded into making a gift to help find the wreckage of Amelia Earhart’s plane. The Court agreed that there was no misrepresentation of fact. Timothy Mellon claimed that The International Group for Historic Aircraft Recovery induced him to make his donation by falsely representing that previous expeditions to the same general location had yet to produce conclusive results. Mellon argued that a video of debris found in a 2010 expedition showed objects from Earhart’s plane. But the trial court ruled, and the Court of Appeals agreed, that the conclusion was Mellon’s opinion...
