Parents of a five-year old African American student in Florida may pursue a suit for discriminatory breach of contract under section 1981 of federal law, a federal District Court in Tampa has ruled. The Court has held that an allegation set forth a cause of action when the parents alleged that the student was precluded from having the opportunity to continue her education when she was the only child excluded from an invitation to move from the school building to classes in the director’s private home after the school had been damaged in a hurricane.
