A nonprofit senior center that provides social events for its members has no obligation to protect a member who is injured when another member fell on her leg during a dance, an appellate court in New York has held. The Court has reversed a trial court decision and granted summary judgment to the center dismissing the claim. Lenox Hill Neighborhood House hosted an event in 2019 for its members and visiting French students that involved music and dancing. One of the members lost his balance during a dance and fell on another member, breaking her ankle. She sued the falling member and the center for negligence.
