Who can be held liable, if anyone, when a woman suffered serious injuries from a fall from exit stairs when she left a “First Night” celebration at a church on New Year’s Eve in Worcester, Massachusetts in 2007? She claimed that the stairway had no railing, that the area was not well lit, and that neither the church nor the nonprofit organization that arranged the annual First Night events provided adequate supervision and security. Since Massachusetts has a charitable immunity rule that limits liability to $20,000, the plaintiff apparently had to sue individuals to recover significant damages.
