Fitness clubs can’t stop city’s $1-a-year lease to YMCA

A group of for-profit fitness clubs has been denied the right to bring suit to challenge a 40-year $1-a-year lease between the City of Charlottesville (VA) and the Piedmont Family YMCA on the ground that they had been denied the right to bid on the project. The Supreme Court of Virginia has ruled that they did not raise a “justiciable controversy” and dismissed the actions. In 2007, the City of Charlottesville advertised for bids for constructing and operating a nonprofit youth and family community recreation facility on public land. The YMCA was the only bidder and in 2008 entered into the lease and a “Use Agreement” with the City and the Albemarle County Board of Supervisors. The Use...
