The Supreme Court of Washington has held that two individual directors of a nonprofit horse rescue organization can be personally liable when the organization causes significant physical damage to property it leases from an owner. The Court has affirmed a trial court decision that the director’s failure to take action when the problems were shown to them amounted to gross negligence and they were not protected by a director protection statute.
