For an employee to invoke the jurisdiction of the EEOC and the courts for Title VII employment discrimination claims, the employer must have at least 15 employees. When Tracy Wright filed a reverse discrimination charge against the nonprofit Memphis Police Association, the union sought to dismiss the case on the ground that it did not have 15 employees. But Wright said that its directors are paid, receive W-2 wage statements, and are included on a wage report filed with the state. The Court cited a 7 th Circuit case denying jurisdiction where directors performed no employee duties and the board reported to no one other than itself.
