A maintenance man who complained that he was a victim of sexual harassment in the spring of 2004 is still trying to have his case heard in court after two trial court and two appeals court proceedings dealing with the question of who was his employer. The janitor worked directly for Main Street Baptist Manor Apartments, which owned and operated a 64-unit apartment in Lexington, KY. Manor did not have enough employees to be covered by either the federal or state anti-discrimination laws.
