University need not advance defense costs of former president

The Court of Appeals of Missouri has held that Kansas City University of Medicine and Biosciences need not advance the costs of legal defense to a former president whom it had sued to recover funds she had allegedly misappropriated. It has held that the bylaw provision requiring board approval “in the specific case” does not require advancement for her where the board did not authorize it for her, even though it did authorize advancement for others sued in the same litigation. In October, 2009, the University began an investigation of the president’s compensation and personal expenses and advanced her money to pay her legal fees.
